The agency may resubmit this ICR after it has addressed the comments that were provided to the agency. The comments in include explaining the relationship between this collection and the initial appeals collection (which DOJ needs to seek PRA approval for), explaining the reasons burden and cost are changing, clarifying how it will ensure the public does not submit redundant fingerprints, and identifying the cost of this collection to the Federal government. This collection should be submitted as a reinstatement with revisions.

Per NICS Final Rule, 28 CFR, Part 25.9 (b) (1), (2) and (3), the NICS must destroy all identifying information on allowed trans- actions. For this reason, a Voluntary Appeal File is required to be established in order for the NICS, to maintain information about the applicant to prevent future erroneous denies or extended delays.

In 2008, the OMB was provided an estimated number of VAF applications that would be sent out to FFLs, appellants, and state POCs because there was no tracking mechanism in place to provide an actual number of applications being distributed. In 2010, the NICS Section began tracking the actual number of VAF applications requested by FFLs, appellants, and state POCs. In 2011 and 2012, the NICS Section introduced the web site that allowed applicants to obtain a brochure on-line and eventually allowed the applicants to apply on-line. Therefore, the 2012 collection reported was lower because less VAF applications were mailed and the NICS Section was providing actual collection numbers instead of estimating the collection.
