JUSTIFICATION FOR CHANGE IN AN OMB CLEARANCE PACKAGE
3150-0213
The Nuclear Regulatory Commission (NRC) amended its regulations that govern packaging and transportation of radioactive material and physical protection of plants and materials. Specifically, the amendments require licensees to provide advance notification to participating Federally-recognized Tribal governments regarding shipments of irradiated reactor fuel and certain nuclear wastes for any shipment that passes within or across their reservations. The rule extends to Tribal officials, his or her designee, and Tribal law enforcement personnel relief from fingerprinting requirements required for access to Safeguards Information (SGI). The participating Tribal government is required to protect the shipment information as SGI. The amended regulations impacted 10 CFR Parts 71 and 73, and affected the burden for 10 CFR Part 73. The NRC packaged both of the impacted information collections into one new information collection which OMB approved and assigned control number 3150-0213.
The purpose of this 83-C is to transfer all remaining burden associated with 3150-0213, “10 CFR Parts 71 and 73, Advance Notification to Native American Tribes of Transportation of Certain Types of Nuclear Waste, Final Rule, to the appropriate existing OMB clearance to 10 CFR Part 73 (3150-0002). NRC seeks to change the burden and responses in clearance 3150-0213 to zero, and to add the burden and responses to the existing control number 3150-0002 for this clearance. The transfer of this burden from 3150-0213 will not change the NRC’s overall burden, but will result in the burden being transferred to the existing collection. Once the entire burden for 3150-0213 has been transferred to the correct clearances, we will submit an 83-D to discontinue 3150-0213. A total burden of 163 hours will be transferred to the existing clearance, resulting in a revised total burden of 0 hours for 3150-0213. This non-substantive change request is a request to transfer a total of 163 hours from 3150-0213 to 310-0002.
