FINAL RULE: Risk-Informed,
Technology-Inclusive Regulatory Framework for Advanced Reactors The
NRC is amending its regulations by adding a risk-informed,
performance-based, and technology-inclusive regulatory framework
for commercial nuclear plants in response to the Nuclear Energy
Innovation and Modernization Act (NEIMA). The current application
and licensing requirements were primarily developed to address
license requests concerning light water-cooled reactors and
operational requirements for those types of reactors. This final
rule responds to NEIMA by creating an alternative,
technology-inclusive regulatory framework to accommodate licensing
of future commercial nuclear plants, including advanced reactor
designs that may not employ light-water technology. The information
collections associated with the final rule have been submitted
under the following clearance numbers: 3150-0146 Burden for 10 CFR
Part 26 (revision) 3150-0274 Burden for 10 CFR Part 53 (new
clearance number for a new CFR Part) 3150-0272 NRC Forms 893 and

The estimated annual burden for
information collection requirements for Part 73 is estimated to be
483,590 hours, an increase of 1,502.3 hours (482,088 hours + 1502.3
hours). The NRC staff anticipates that there will be one licensee
under Part 53 in the period covered by this clearance. The
information collection is essential to permit NRC to make a
determination as to the adequacy of the licensee’s plans to protect
computer and communication systems and networks against
cyberattacks, protect the plant against physical attacks, and
ensure that unauthorized persons do not have access to the
commercial nuclear plant, and that authorized persons are
trustworthy and reliable.

with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
