Pursuant to the requirements of TSCA Title VI, EPA is proposing a framework for a third-party certification program for composite wood products. The third-party certifiers (TPCs) would be responsible for activities such as regularly auditing manufacturers, conducting and verifying formaldehyde emissions tests, and ensuring that manufacturer quality assurance and quality control procedures and testing complies with the regulations set forth in this rule. Under the proposed framework, participating accreditation bodies (ABs) would, among other activities, accredit TPCs, audit TPCs, maintain records on their accredited TPCs, and report to EPA on TPCs' activities.

On July 7, 2010, the Formaldehyde Standards for Composite Wood Products Act (PL 111-199) was enacted as an amendment to the Toxic Substances Control Act (TSCA). The new provisions, enacted as TSCA Title VI, mandates that the EPA Administrator promulgate regulations to implement the standards in a manner that ensures compliance with the regulatory emission standards. The program changes identified in the supporting statement are related entirely to the new law and EPA's proposed regulation to implement it.
