Abstract: The CFTC needs to know who the persons are who claim relief from the swap dealer definition to engage in utility commodity swaps with utility special entities. The information will be used to ensure that the relief is not abused, that persons who should be registered as swap dealers do so, and that utility special entities are treated fairly.

Short Statement: The Commission is amending its Regulation 1.33(ggg) to provide a separate de minimis exception from the swap dealer definition for persons engaging in utility commodity swaps with utility special entities. The Commission estimates that 100 persons will file one response annually for a total of 100 responses.
