To determine eligibility for de minimis exception under the regulations, affiliated groups with more than one health insurance issuer need to designate a health insurance issuer that will be a parent entity. The designation must be in writing, but is not required to be submitted to the IRS (but will be requested on audit). The respondents are affiliated groups with more than one health insurance issuer.
