The grade crossing inventory, used by
States and railroads, reports changes to or closings of grade
crossings to update or add to the existing National Inventory File.
Previously, railroads and States submitted this information
voluntarily. This final rule -- and associated information
collection -- requires railroads that operate one or more trains
through highway-rail or pathway crossings to submit information to
the U.S. DOT National Highway-Rail Crossing Inventory about the
crossings through which they operate. These amendments, mandated by
section 204 of the Rail Safety Improvement Act of 2008, require
railroads to submit information about previously unreported and new
highway-rail and pathway crossings to the U.S. DOT National
Highway-Rail Crossing Inventory and to periodically update existing
crossing data.
The total burden has increased
by 7,379 hours from the last approved submission. The change in
burden is due solely to program changes resulting from the final
rule's new requirements on railroads. Previously, crossing
inventory data were provided voluntarily both by railroads and
States. The table provided in the answer to question number 12 of
the attached Supporting Justification reflects all the program
changes. Program changes depicted in the provided table increased
the burden by 7,379 hours and increased responses by 178,775 from
the last approved submission. The current OMB inventory shows a
total burden of 8,054 hours, while the present submission exhibits
a total burden of 15,433 hours. Hence, there is a total increase of
7,379 hours. As noted in the regulatory impact analysis
accompanying this final rule and in the answer to question number
13 above, the cost to respondents has increased by $1,998,174, and
results from a program change associated with the mandatory
requirements of this final rule.
