The National Emission Standards for Hazardous Air Pollutants (NESHAP) for the regulations published at 40 CFR subpart XXX were proposed on August 4, 1998, promulgated on May 20, 1999, and amended most recently on March 22, 2001. The purpose of this information collection request is to document the expected impacts of proposed changes to subpart XXX that are being developed as part of the risk and technology review process of the current subpart XXX. Subpart XXX would continue to apply to new and existing ferroalloys production facilities that manufacture ferromanganese and silicomanganese, and that are either major sources of hazardous air pollutants (HAPs) emissions or are co-located at major sources of HAPs. The following affected facilities at ferroalloy production plants are subject to this NESHAP rule: submerged arc furnaces; casting operations, metal oxygen refining (MOR) process; crushing and screening operations; and fugitive dust sources. New sources include those that commenced construction or reconstruction after the date of proposal. This information is being collected to assure compliance with 40 CFR part 63, subpart XXX. Compared to existing subpart XXX, the proposed changes would increase the number of pollutants and sources regulated and add requirements for continuous monitoring and periodic testing. In addition, the proposed rule would eliminate the startup, shutdown and malfunction (SSM) exemption, remove the SSM plan requirement, add provisions to provide an affirmative defense against civil penalties for exceedances of emission standards caused by malfunctions and add a requirement for electronic submittal of performance tests.
