This rule regulates the disposal of
CCR generated by electric utilities as solid waste under RCRA
Subtitle D and finalizing national minimum criteria for existing
and new CCR landfills and existing and new CCR surface impoundments
and all lateral expansions. To address concerns about the absence
of adequate regulatory oversight under Subtitle D, EPA has sought
to enhance the protectiveness of the regulatory requirements by
providing for state and public notifications of the third party
certifications, as well as requiring a robust set of other
information that documents the decisions made or actions taken to
comply with the technical requirements of the rule.
