SUBJECT: Office of Management and Budget (OMB) Emergency Submission for
The Defense Materiel Disposition Procedures for the Sale of DoD
Materiel
•

The Under Secretary of Defense for Acquisition, Technology, and Logistics,
Defense Logistics Agency, is submitting the subject requirement for
emergency review and approval of the subject information collection request
(ICR).

•

The purpose of this emergency submission is to obtain OMB accelerated
approval to use forms specifically developed for DoD to assess the ability of
prospective purchasers of goods, via the Defense Materiel Disposition
Program, meet the responsibility criteria in part 102 of Title 41, Code of
Federal Regulations (CFR) and comply with applicable laws and regulations
before DoD sells the materiel.

•

These specific forms will be used to collect information needed to facilitate
appropriate clearance checks. Release of DoD property without these
clearance checks poses a risk to national security, because individuals and
countries, whose interests are counter to those of the United States, target
property for their military utility and value.

•

OMB approval of this emergency ICR is required before the Defense
Materiel Disposition Interim Final Rule (RIN 0790-AJ11) can be
implemented. Failure to implement this rule at the earliest will lead to a
continuing reliance on individual waivers and exceptions to current DoD
policy. A lack of clear guidance will cause potential confusion on the part
of both the public and the Department of Defense and sub-optimize the
disposition decision-making process. The forms in this ICR will be used to

address Congressional, General Accounting Office, and DoD Inspector
General findings related to the rule.
•

The DoD cannot reasonably comply with the normal clearance procedures
under title 5, CFR, Part 1320, since such procedures would delay or disrupt
the collection of the information.

•

As the DoD Clearance Officer, I have reviewed the submission and
determined that it complies with the Paperwork Reduction Act (PRA)
and its implementing regulation, title 5, CFR, Part 1320, “Controlling
Paperwork Burdens on the Public.”

•

The PRA submission package consisting of the Supporting Statement; SF
114: Sale of Government Property Item Bid Page; DRMS 1645: Statement
of Intent; DRMS 2006: Pre-Award Review; the draft Agency Disclosure
Notice; the memo to OMB; the OMB Form 83-I; and the Statement of
Determination are attached.
