10 CFR Part 40 establishes requirements for licenses for the receipt, possession, use and transfer of radioactive source and byproduct material. The application, reporting and recordkeeping requirements are necessary to permit the NRC to make a determination on whether the possession, use, and transfer of source and byproduct material is in conformance with the Commission's regulations for protection of public health and safety.

JUSTIFICATION FOR CHANGE IN AN OMB CLEARANCE PACKAGE 3150-0215 The Nuclear Regulatory Commission (NRC) amended its regulations in 10 CFR Part 40 to establish new requirements for distributors of source material to persons exempt from the regulations or for use under a general license in § 40.22. In addition, the rule modified the existing possession and use requirements for § 40.22 general licensees to align the requirements with current health and safety standards. Finally, the rule revised, clarified, or deleted certain exemptions in § 40.13(c) to make the exemptions more risk informed. Conforming changes were made to 10 CFR Parts 30, 70, 170 and 171. These changes affected manufacturers and distributors of products and materials containing source material and future users of some products used under exemptions from licensing and under the § 40.22 general license. The changes resulted in an increase in burden for 10 CFR Parts 19, 20, and 40, as well as additional reporting burden on NRC Form 313, Application for Materials License. The purpose of this 83-C is to transfer all burden associated with 3150-0215, "10 CFR Parts 30, 40, 70, 170 and 171, Distribution of Source Material to Exempt Persons and to General Licensees and Revision of General License and Exemptions, Final Rule, to the appropriate existing OMB clearance to 10 CFR Part 40 (3150-0020). NRC seeks to change the burden and responses in clearance 3150-0215 to zero, and to add the burden and responses to the existing control number 3150-0020 for this clearance. The transfer of this burden from 3150-0215 will not change the NRC's overall burden, but will result in the burden being transferred to the existing collection. Upon approval of the non-substantive change request, we will submit an 83-D to discontinue 3150-0215. A total burden of 281 hours will be transferred to the existing clearance 3150-0020, resulting in a revised total burden of 0 hours for 3150-0215. This non-substantive change request will transfer a total of 281 hours from 3150-0215 to 310-0020. NOTE: This submission is a revision to 10 CFR Part 40 (3150-0020). The burden associated with this rule could not be submitted under Part 40 (3150-0020) because the information collection was up for renewal and ROCIS only allows one submission per clearance number at any given time.
