with 5 CFR 1320, OMB is withholding approval at this time. The
agency shall examine public comment in response to the proposed
rulemaking and will include in the supporting statement of the next
ICR--to be submitted to OMB at the final rule stage--a description
of how the agency has responded to any public comments on the ICR,
including comments on maximizing the practical utility of the
collection and minimizing the burden. In addition, OMB reminds the
agency to conduct consultation with up to 9 outside entities once
every three years on the availability of data, frequency of
collection, clarity of instructions and recordkeeping requirements,
disclosure, or reporting format (if any), and on the data elements
to be recorded, disclosed, or reported.

PROPOSED RULE, APPROVAL OF AMERICAN
SOCIETY OF MECHANICAL ENGINEERS' CODE CASES This proposed rule is
the latest in a series of rulemakings that incorporate by reference
new versions of several RGs identifying new and revised
unconditionally or conditionally acceptable ASME Code Cases that
are approved for use. In developing these RGs, the NRC staff
reviews ASME BPV and OM Code Cases, determines the acceptability of
each Code Case, and its findings in RGs. The RGs are revised
periodically as new Code Cases are published by the ASME. The NRC
incorporates by reference the RGs listing acceptable and
conditionally acceptable ASME Code Cases into 10 CFR part
50.55a.
The proposed rule would
decrease the burden for Part 50 from 4,382,153 hours and 45,202
responses to 4,367,713 hours and 45,164 responses, a reduction of
14,440 hours and 38 responses. The proposed rule reduces burden by
incorporating by reference recent ASME Code Cases. As a result of
this incorporation by reference, burden on licensees to submit 5
requests for alternatives under 10 CFR 50.55a(z) will be reduced.
Licensees would no longer need to submit alternative requests in
order to use these Code Cases, once they are included in NRC’s
Regulatory Guides.
