PROPOSED RULE: 10 CFR PARTS 20 AND 61,
LOW-LEVEL RADIATION WASTE DISPOSAL The NRC is proposing to amend
its regulations to require LLRW disposal facilities to conduct
site-specific technical analyses to demonstrate compliance with the
performance objectives of 10 CFR part 61. The intent of the rule is
to ensure performance objectives are met at disposal sites for safe
disposal of LLRW that was not analyzed in the original 10 CFR part
61 regulatory basis (i.e., large quantities of depleted uranium).
The site-specific technical analyses would include compliance
period analyses with both a performance assessment and an intruder
assessment, analyses for the protective assurance period that
include both a performance assessment and an intruder assessment,
performance period analyses to evaluate how the disposal system
could mitigate the risk from long-lived LLRW, new analyses that
demonstrate the disposal site includes defense-in-depth
protections, and an LLRW acceptance plan identifying the WAC for
the disposal facility. In addition, licensees must review their
LLRW acceptance plan annually and update the safety case and
analyses as part of the application for closure. The NRC Forms 540
and 541 would be updated to allow licensees to indicate the use of
LLRW acceptance criteria.
