The OSH Act and 29 CFR Part 1904
prescribe that certain employers maintain records of job related
injuries and illnesses. The data are needed by OSHA to carry out
intervention and enforcement activities to guarantee workers safe
and healthful workplaces. The data are also needed by BLS to
produce national statistics on occupational injuries and illnesses.
This Final makes changes to OSHA's reporting system for
occupational injuries and illnesses. An updated and modernized
reporting system enables a more efficient and timely collection of
data, and improves the accuracy and availability of the relevant
records and statistics. This rulemaking involves modification to 29
CFR part 1904.41 to expand OSHA's legal authority to collect and
make available injury and illness information required under part
1904, and a modification to 29 CFR part 1904.35 to clarify an
employee’s right to report injury and illnesses to their employer
without fear of retaliation.

The burden hours for the
additional reporting requirements contained in the 1904.41 are
estimated to be 173,406 hours, program change, for the initial year
of implementation. There is an adjustment decrease of 750,637
burden hours due to decreases in 1) the number of establishments
covered by the recordkeeping rule; 2) the number of injuries and
illness recorded by covered employers; and 3) the number of
fatalities, amputations, hospitalization, and loss of eye reported
by employers. These estimates have all been updated using the most
current data available.
