This ICR was
improperly submitted. The abstract incorrectly indicates that DOT
is seeking emergency processing under the PRA. In addition, the ICR
indicates there are program changes due to agency discretion but
the ICR does not properly identify or explain those changes in
supporting statement question 15 or in ROCIS's burden short
statement. DOT may resubmit this ICR when these and any other
deficiences are corrected.

The FAA Modernization and Reform Act
requires US carriers that operate scheduled passenger service or
public charter service using any aircraft with a design capacity of
30 or more seats, and operators of large hub, medium hub, small
hub, or non-hub US airports, to submit contingency plans for
lengthy tarmac delays to the Secretary of Transportation for review
and approval no later than May 14, 2012. The Act also requires each
covered carrier and airport to ensure public access to its plan
after DOT approval by posting the plan on its website. The
Department is seeking OMB approval for the submission and posting
of these plans under the PRA emergency clearance process because
use of the normal clearance procedures is reasonably likely to
cause the May 14 statutory deadline for submission of plans to be
missed.

In 2012, US DOT created an
online system allowing covered U.S. air carriers and airports to
submit plans online. Pursuant to the requirements of the Act, the
Department reviewed and approved emergency contingency plans
submitted by over 450 covered air carriers and airports. The
Department is now seeking reinstatement of the OMB control number
to collect plan updates for covered U.S. air carriers and airport
operators. The OMB control number also covers posting of plans on
carrier and airport websites.
