The EPA is finalizing revisions for
the National Emission Standards for Hazardous Air Pollutants
(NESHAP) for Polyether Polyols. Potential respondents subject to
the new requirements of the NESHAP include an estimated 23 existing
facilities that produce polyether polyols. The EPA is finalizing
amendments which require that that there be no discharge to the
atmosphere from any pressure relief device (PRD) on any equipment
in HAP service within the process units for the Polyether Polyols
source category. To ensure compliance with this requirement,
facility owners or operators are required to monitor each PRD with
equipment that would be able to identify and record the time and
duration of each pressure release and notify operators that a
pressure release has occurred. The final amendments also add
provisions for facility owners or operators to use if they wish to
assert an affirmative defense to avoid civil penalties for
exceedances of the applicable standards that are caused by a
malfunction. If these provisions are used, the owner or operator is
required to meet certain criteria during the malfunction, notify
the Administrator of malfunctions that may cause an exceedance of
the emissions standards, and submit a report of the malfunction to
the Administrator, to include a root cause analysis of the
malfunction, within certain timeframes.
There is a small increase in
labor hours in this ICR compared to the previous ICR. This is due
to the removal of affirmative defense and the addition of a
one-hour estimate associated with re-familiarization of the
regulatory requirements for each regulated source. There is also a
decrease in the total capital and O&M costs. Since all existing
sources are expected to be compliant with any initial requirements
of the 2014 rule, the estimated capital cost has decreased since
the last ICR.
