Sections 507(b), 508(a) and 516(b) of Public Law 95-87 require underground coal mine permit applicants to submit an operations and reclamation plan and establish performance standards for the mining operations. Information submitted is used by the regulatory authority to determine if the applicant can comply with the applicable performance and environmental standards required by the law.

Although there has been a significant decrease in the number of new permit applications for underground mines in the past three years, this decrease is mostly offset by the addition of including significant revisions in our respondent count. Also, the average hourly burden for permit applicants to prepare these specific portions of an underground mining permit application or a significant revision, and for the regulatory authority to review an application, has noticeably increased in the past three years. We are requesting 21,612 burden hours, an increase of 6,706 hours from the currently approved level of 14,906 hours. We are seeking a decrease in non-wage cost burden of $48,760, for a new total of $390,350 as a result of adjustments in the number of responses.
