Dear Mr. Mancini:
In accordance with title 5, Code of Federal Regulations (CFR) Act, Part
1320.13, “Emergency Processing,” the Department of Defense requests
emergency processing and approval of a public information collection. The
purpose of this emergency submission is to obtain applicable retirement
information from Uniformed Service members and allow those members to make
certain retired pay and survivor annuity elections prior to retirement from service
or prior to reaching eligibility to receive retired pay. The collection will also allow
eligible members covered by the Blended Retirement System to make voluntary
election of a partial lump sum of retired pay, as required by Section 1415 of Title
10, United States Code. The Paperwork Reduction Act (PRA) submission package
has been uploaded into ROCIS.
The Department of Defense cannot reasonably comply with the normal
clearance procedures under title 5, CFR, Part 1320. Complying with the normal
clearance procedures is likely to delay or disrupt the collection of information, and
could have a negative impact on our service members, and compliance with new
statute requirements effective as of January 1, 2018. The final authority to
administer the Survivor Benefit Plan for those members who elect a lump sum of
retired pay was not signed into law until December 12, 2017, and the Department
could not be certain of the process that would be signed into law until at least
November 13, 2017. Therefore the Department was unable to take action on this
submission process because of uncertainty that the necessary law would pass.
Immediately after it became apparent that the necessary statutory change would be
included in the final version of the NDAA for FY18, the Department conducted
rapid internal coordination of the necessary changes to DD Form 2656, which is
the form that comprises this PRA submission.

The information collection is essential to the mission of the Department.
Given this, the Department is requesting emergency approval by December 31,
2017.
