It is mandatory that an air carrier or
other person report information to this collection in order to have
an information program designated as protected under Section 40123.
Air carriers or other persons submit an application for an
individual program on occasion of requesting protection of
information. The FAA evaluates the application and either publishes
a designation based on the application for public comment or denies
the application. After comments are received, the FAA reviews them
and evaluates whether the elements in § 193.5 114, have been met.
An Order designating the information protected is published in the
Federal register. The order includes summaries of why the
Administrator finds that the elements are met. By publishing the
Order in the Federal Register, all interested persons are able to
see that they can provide information under the program and receive
the protection described in Section 40123 and part 193.

There has been an increased
estimate of burden since the previous submission due to a new
method of calculating burden more accurately. In previous
Supporting Statements, the FAA has based its burden calculations on
the number of participating air carriers. However, each air carrier
may participate in multiple programs and part 145 certificate
holders (maintenance facilities) now also participate in these
programs. Therefore in order to increase accuracy regarding the
calculation of burden, the FAA now looks at the number of
respondents based on data regarding participation in the pertinent
voluntary programs. Currently, there are 930 participants in the
FAA’s voluntary programs. Because the FAA has greatly increased the
number of respondents from previous submissions due to increased
efficacy regarding data gathering, the FAA is accounting for all
previous initial submissions from current respondents.
