EPA has participated in the development of international aircraft engine emission standards through the International Civil Aviation Organization (ICAO) Committee on Aviation Environmental Protection (CAEP) in conjunction with the Federal Aviation Administration (FAA), industry, international regulators, and environmental groups. Subsequently, EPA has adopted these requirements into its own regulations, and FAA has adopted regulations for their implementation and enforcement. Under Clean Air Act (CAA), EPA has the authority to establish aircraft engine emission standards and the pertinent reporting requirements, while the FAA has the authority to enforce the standards. In February 2016, the ICAO/CAEP adopted a new international test procedure, emissions standard, and reporting requirement for non-volatile Particulate Matter (nvPM) emissions for aircraft gas turbine engines with rated output greater than 26.7 kN. These new requirements become effective January 1, 2020, and they are intended to facilitate a transition from the existing international smoke standard which has been in place for over 30 years. ICAO/CAEP views this as a change in test procedure and transitional requirement for gathering data for the initial nvPM standards that CAEP is developing. ICAO requirements need to be implemented domestically under an international treaty, and thus, the amendment to our ICR for this new nvPM data would meet this obligation for the U.S.
