The U.S. Nuclear Regulatory Commission
(NRC) regulations in Part 40 of Title 10 of the Code of Federal
Regulations establish procedures and criteria for the issuance of
licenses to receive title to, receive, possess, use, transfer, or
deliver source and byproduct material. The application, reporting,
recordkeeping, and third party notification requirements are
necessary to permit the NRC to make a determination as to whether
the possession, use, and transfer of source and byproduct material
is in conformance with the Commission’s regulations for protection
of public health and safety.
The overall burden increased by
6,503 hours from 10,425 to 16,928 hours. The net increase in burden
results from an overall decrease in estimated NRC licensee burden
(-2,088.6 hours) and an increase in Agreement State licensee burden
(+8,591.5 hours). --The NRC staff adjusted the estimated number of
materials licensees responding to the reporting and recordkeeping
requirements to reflect an increase in transfer of control of
materials licensees and increased site decommissioning under
40.42(j)(2) (sites may refer to a location of use stated in the
license, and not necessarily a license termination). This went from
0 NRC licensee respondents in the past renewal to 6 NRC licensee
respondents for this renewal (0 to 600 hours increase.) --The
estimated number of Agreement State licensees submitting radiation
surveys under 40.42(j)(2) increased from 0 to 39. At 100 hours per
report, this represents an increase of 3,900 hours. The NRC staff
believes this increase corresponds to an increase in
decommissioning of sites and license terminations, which is a trend
as seen by the gradual decrease in NRC and Agreement State licenses
over the years. --The NRC has adjusted the reporting requirements
for licensees in the Materials Licensing Program (NRC and Agreement
State) to reflect a new information collection under 10 CFR
40.13(a) and 10 CFR 40.51(b)(3). The regulations in 10 CFR
40.51(b)(3) provide for the transfer of source material to persons
exempt from licensing under 10 CFR 40.13(a). Although the
regulations in Part 40 do not require prior written approval for
transfers of unimportant quantities of source material to persons
exempt from licensing, some licensees have requested NRC approval
for these transfers. As a result, the NRC staff has included the
burden for the voluntary reporting of requests for approval of
exempt transfers. The NRC has drafted guidance for licensees who
choose to submit this information on a voluntary basis. The NRC
estimates that two responses will be received during the next three
years from NRC licensees. The burden hours for preparation of the
documentation for this approval has been estimated at 100 hours,
for a total of 200 hours of burden for NRC licensees. The number of
estimated Agreement State responses for this information collection
has been calculated using the aforementioned ratio of Agreement
State materials licenses to NRC materials licenses, resulting in a
burden increase of 1300 hours (13 AS licensees x 100 hours per
response). This change results in a 1,500 hour overall increase
(200 hours for NRC licensees + 1,300 hours for AS licensees.) The
fifteen responses and 1,500 hour increase associated with this
change are due to a program change due to agency discretion and are
marked as such on the submission in ROCIS.
