Abstract: On April 17, 2015, the Environmental Protection Agency (EPA or the Agency) promulgated national minimum criteria for existing and new coal combustion residuals (CCR) landfills and CCR surface impoundments. Following promulgation of this final rule, stakeholders have raised issues related to specific requirements of the final rule. On March 15, 2018, EPA proposed several changes to the 2015 CCR rule and on July 30, 2018, EPA finalized certain specific changes. In this action, EPA is proposing additional targeted changes to the 2015 CCR rule and is soliciting comment on other issues. The Agency is also proposing a rule that addresses two provisions of the final rule that were remanded back to EPA on August 21, 2018 by the U.S. Court of Appeals for the D.C. Circuit.
