We are proposing new requirements for hospitals to post their standard charges including gross charges and all third party payer negotiated charges for all items and services in a machine-readable format, and all third party payer negotiated charges for 70 CMS-specific and 230 hospital-selected shoppable services in a consumer-friendly format in Title 45 of the CFR under new Part 180 under new proposed Subchapter E. We are proposing these policies to implement Section 2718(e) of the Public Health Service Act (the PHS Act), which directs that each hospital operating within the United States must establish and make public a list of its standard charges for items and services, including for diagnosis-related groups. Specifically, section 2718(e) of the PHS Act requires that each hospital operating within the United States, for each year, establish (and update) and make public (in accordance with guidelines developed by the Secretary) a list of the hospitalâs standard charges for items and services provided by the hospital, including for diagnosis-related groups established under section 1886(d)(4) of the Act.
