Abstract: The Department of Education (the Department) proposes to amend the Student Assistance General Provisions regulations to implement changes to §668.5 – Written arrangements to provide education programs. These proposed regulations are a result of negotiated rulemaking in early 2019 and would add new requirements to the current regulations. The proposed regulations in §668.5 would require an eligible institution to demonstrate how the ineligible institution with which it has partnered has the experience in the delivery and assessment of the program or portions thereof that the ineligible institution would be contracted to deliver under the terms of the written arrangement.
