Terms of Clearance: This ICR was submitted over a year after the final rule was published. The burden estimates are only for 2019-2021, and 2020 is nearly over. OMB is issuing a one year approval of this information collection. Upon resubmission, OMB requests that EPA use actual burden estimates based on any SIP revisions that may or may not have occurred because of the 2019 final rule, Emissions Monitoring Provisions in State Implementation Plans Required Under the NOX SIP Call (RIN 2060–AU08).

Abstract: The NOx Budget Trading Program was a market-based cap and trade program created to reduce emissions of nitrogren oxides (NOx) from power plants and other large combustion sources in the eastern United States. NOx is a prime ingredient in the formation of ground-level ozone (smog), a pervasive air pollution problem in many areas of the eastern United States. The NOx Budget Trading Program was designed to reduce NOx emissions during the warm summer months, referred to as the ozone season, when ground-level ozone concentrations are highest. In 2009, the program was replaced by an ozone-season NOx trading program under the Clean Air Interstate Rule (CAIR), which has in turn been replaced by the ozone-season NOx trading programs under the Cross-State Air Pollution Rule (CSAPR). Although the NOx Budget Trading Program was replaced after the 2008 compliance season, this information collection is being renewed because industrial sources in certain States are still required to monitor and report emissions data to EPA under these rules, so we will account for their burden.
