Section 326 of the USA PATRIOT Act added subsection (l) to 31 U.S.C. 5318 of the BSA. Pursuant to section 326, FinCEN issued joint regulations with the Securities and Exchange Commission that require mutual funds to establish a written customer identification program and to maintain records related to verifying the identity of customers. Under the customer identification program (“CIP”) regulations, the minimum requirements include: 1) implementation of a written customer identification program appropriate for the financial institution’s size and type of business; 2) identity verification procedures; 3) recordkeeping; 4) comparison with government lists; and 5) customer notice.

The estimated total annual burden hours increased from 666,667 hours since the last control number renewal in 2018 to 684,168 hours. The estimated number of mutual funds remained at 1,591, and the estimated number of new accounts opened per year remained at 20,000,000 with an estimate of 2 minutes per account to collect CIP information. The increase in burden of 17,501 hours is a result of the burden estimate of 10 hours per mutual fund to update and maintain the CIP, and one hour per mutual fund to provide customers with notification of the CIP requirements.
