Rule 604 requires, with certain exceptions, specialists and market makers to display customer limit orders that are priced superior to the quote that the specialist or market maker is currently displaying. Customer limit orders that match the bid or offer being displayed by the specialist or market maker must be reflected in the quote if the limit order price also matches the national best bid or offer when the size of the customer limit order is more than de minimis. Regarding the emergency reinstatement: The Commission and staff participate in ongoing dialogue with representatives of various market participants through public conferences, meetings, and informal exchanges. However, because the Commission is requesting a reinstatement of a previously approved information collection on an emergency basis, the Commission has not yet specifically solicited comments on this information collection. If reinstatement is granted, the Commission will publish a notice soliciting comments in the Federal Register prior to seeking an extension of the term of the information collection.
This OMB number was previously reinstated just last year. However, due to an issue with our internal tracking system, it was inadvertently allowed to expire. We are requesting emergency approval so that the number may be reinstated while we work on the extension. We have reviewed the burden estimates and Supporting Statement that were previously submitted and we do not have any changes. In addition, we have attached a separate memo to request the emergency reinstatement.
