Furnishing of Samples

  1. Justification

  1. Necessity of Information Collection

ATF is responsible for enforcing Title XI of the Organized Crime Control Act of 1970 (the Act) and implementing regulations contained at 27 CFR Part 555. Subtitle C of Public Law No. 107-296, the Safe Explosives Act, enacted November 25, 2003, amended the Act to require that: “Licensed manufacturers and importers and persons who manufacture or import explosive materials or ammonium nitrate shall, when required by the Director, furnish; i. Samples of explosive materials or ammonium nitrate, ii. Information on the chemical composition of these materials, and iii. Any other information the Director deems appropriate.” This requirement is specified at 27 CFR § 555.110.

  1. Needs and Uses

This information will be used by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for law enforcement, regulatory, classification and scientific or research purposes.

  1. Use of Information Technology

The use of information technology does not apply to this collection. The respondent must furnish the actual sample to ATF.

  1. Efforts to Identify Duplication

There is no duplication associated with this collection. No other sources request this information.

  1. Minimizing Burden on Small Business

This collection will not substantially affect small businesses.

  1. Consequences of not conducting or less frequent Collection

ATF must be able to identify the explosive materials or the ammonium nitrate. Without this information collection individuals could manufacture or import dangerous materials.

  1. Special Circumstances

This collection may require respondents to submit proprietary information. Such information will be protected under normal ATF disclosure practices.

  1. Public Comments and Consultations

No comments were received during the 60-day Federal Register Notice period. However, a 30-day FR notice will be published to solicit public comments.

  1. Provision of Payments or Gifts to Respondents

No payment or gift is associated with this collection.

  1. Assurance of Confidentiality

The samples of explosive materials or ammonium nitrate are kept in a secure location at the ATF laboratory. Confidentiality is not assured.

  1. Justification for Sensitive Questions

No questions of a sensitive nature are asked.

  1. Estimate of Respondent’s Burden

We estimate that there are a total 100 respondents who provide responses to this information collection request once per year. The total number of responses is also 100. Each respondent will take approximately 30 minutes to submit the samples and required documentation. This estimate includes time to read any relevant materials, gather the samples, and prepare any necessary documentation. The total annual burden hours associated with this burden request is 50 hours.

  1. Estimate of Cost Burden

ATF estimates a cost burden of $20.00 to the respondent. The cost is estimated at $20 x 100= $2,000. The regulations at 27 CFR Section 555.110 provide for reimbursement for the cost of the materials. Therefore, the cost to the respondent will be reported as 0.

  1. Cost to Federal Government

There is no cost to the Federal government.

  1. Reason for Change in Burden

There are no program changes or adjustments associated with this collection.

  1. Anticipate Publication Plan and Schedule

The results of this collection will not be published.

  1. Display of Expiration Date

ATF does not request approval to omit the Office of Management and Budget expiration date for this collection.

There are no exceptions to the certification statement.
