Part 40 of 10 CFR establishes requirements for the receipt, possession, use, and transfer of radioactive source and byproduct materials. Section 40.25 established a general license authorizing the use of depleted uranium contained in industrial products or devices for the purpose of providing a concentrated mass in a small volume of the product or device. The NRC Form 244 is used to report the receipt and transfer of depleted uranium, as required by § 40.25. The registration information required by the NRC Form 244 enables the NRC to make a determination on whether the possession, use, or transfer of depleted uranium source and byproduct material is in conformance with the NRC’s regulations for the protection of public health and safety.

The number of registration certificates submitted annually by NRC licensees has remained constant. The number of registration certificates submitted by Agreement State licensees has been estimated to have increased from 6.5 to 7.3, resulting an increase of approximately 0.8 hours of burden ([7.3 – 6.5] certificates x 1 hour per certificate = 0.8 hours). The increase in burden is due to the increased number of submitted responses. The increase in the number of responses as reported above is due to the increase in estimated Agreement State responses and the correction to an error made in the previous submittal that understated the number of annual responses. The correct number of responses was in the supporting statement. The increase in overall burden can also be attributed to the estimated increase in Agreement State responses.
