Terms of Clearance: Prior to the re-submission of the information collection (IC) “Transitional Coverage and Retroactive Medicare Part D Coverage for Certain Low-Income Beneficiaries through the Limited Income Newly Eligible Transition (LI NET) Program” (0938-1441), CMS will assess linguistic preferences across the Medicare population and translate this IC into additional languages as appropriate in order to increase accessibility and reduce health disparities. It is the expectation that CMS will translate this form into more languages that English and Spanish, but the number of additional languages will be based on the agency’s assessment its population needs but these languages could include both Traditional and Simplified Chinese, Vietnamese, Korean, Tagalog, Arabic, French, and Russian. This request is supported by the principles and priorities set forth in the memorandum titled “Improving Access to Public Benefits Programs Through the Paperwork Reduction Act” (April 13, 2022), the Executive Order 13985 on “Advancing Racial Equity and Support for Underserved Communities Through the Federal Government” (January 20, 2021), and the culturally and linguistically appropriate services (CLAS) standards (https://thinkculturalhealth.hhs.gov/clas/what-is-clas).

Abstract: Section 118 of the Consolidated Appropriations Act, 2021 (CAA) (Public Law 116-260) enacted on December 27, 2020, amended Section 1860D-14 of the Social Security Act (the Act) (42 U.S.C. 1395w-114) and authorized CMS to make transitional coverage and retroactive Medicare Part D coverage for certain low-income beneficiaries, called the Limited Income Newly Eligible Transition (LI NET) program a permanent part of the Part D program. The LI NET program under this statute must begin no later than January 1, 2024.

Short Statement: Based on the provisions in our April 12, 2023 (88 FR 22120) final rule (CMS-4201-F; RIN 0938-AU96), this is a new collection of information request that adds 110,686 responses, 11,701 hours, and $433,175. The requirements include two forms for beneficiaries use: • Application to Enroll in the Limited Income Newly Eligible Transition (LI NET) Program • Direct Reimbursement Request for the Limited Income Newly Eligible Transition (LI NET) Program There are no private sector forms for pharmacists and for LI NET sponsors.
