This information collection covers requirements related to use of DoD program nomenclature. The solicitation provision at 252.227-70XX, Identification of Asserted marks, requires offerors to submit an asserted-marks list along with their offer. The contract clause at 252.227-70YY, Contractor Use of Government Designations, allows contractors to update the asserted-marks list, under certain circumstances, during contract performance.

DoD is proposing to amend the DFARS to introduce coverage of contract-specific designations such as trademarks, popular names, and program names. This coverage is intended to foster transparency regarding claimed ownership of such designations and to avoid or minimize conflict between DoD and offerors and contractors over rights to such designations.
