Internal Revenue Code (IRC) section 163(d) provides a limitation on the amount individuals, estates, or trusts can use as investment interest expense deduction. The deduction is limited to the taxpayerâs net investment income for the taxable year. The taxpayer can carry forward excess deduction amounts to future years.
Individuals, estates, and trusts use Form 4952, Investment Interest Expense Deduction, to accumulate a taxpayerâs interest from all sources and provide a line-by-line computation of the allowable deduction for investment interest.
US Code:
26 USC 163(d)
Name of Law: Limitation on investment interest.
There is no change in the paperwork burden previously approved by OMB. However, the estimated number of responses was updated to eliminate duplication of the burden associated with individual respondents captured under OMB control number 1545-0074. This reduces the number of responses by 605,763 and the burden hours by 908,645 annually due to Agency Discretion.
