Abstract: BJS began the FIST program in 1995 as a means to develop annual national estimates of the total number of firearm transfer and permit applications received and denied pursuant to the Brady Handgun Violence Prevention Act of 1993 (the Brady Act) (Pub. L. No. 103-159, 107 Stat. 1536 (1993), as amended at 18 U.S.C. Section 921 et seq.). The Brady Act mandates a criminal history background check be conducted on any person who attempts to purchase a firearm from a Federal Firearms Licensee (FFL). The permanent provisions of the Brady Act established the National Instant Criminal Background Check System (NICS). The NICS is operated by the Federal Bureau of Investigation (FBI) and maintains data on persons who are prohibited from purchasing or possessing a firearm under the Brady Act or under state law. The NICS is accessed by the FBI or a state point-of-contact (POC) prior to allowing a transfer of a firearm to proceed.

Short Statement: The number of respondents is subject to change as changes to state laws may impact the number of checking agencies. Minor changes will occur on the survey instrument to reflect which types of applications or checks are relevant to the specific state the respondent is in. There is no change in the average annual respondent burden. BJS anticipates that the respondent burden for the 2023-2026 collections will average 25 minutes per respondent annually, consistent with the 2021 and 2022 collections.
