This information collection implements a statutory certification requirement related to conflicts of interest in contracts for certain consulting services. The solicitation provision added in the interim rule for DFARS Case 2024-D007, Preventing Conflicts of Interest for Certain Consulting Services, requires offerors to certify whether they or any of their subsidiaries or affiliates hold a contract that involves consulting services with one or more covered foreign entities and whether they maintain a conflict-of-interest mitigation plan that meets the requirements listed in the solicitation provision. If so, offerors may be required to submit to the contracting officer their conflict-of-interest mitigation plan.
This information collection is needed on an emergency basis to enable DoD to begin collecting the information immediately. Immediate collection is necessary both to enable DoD to mitigate the risk associated with performance of DoD contracts for certain consulting services and to comply with the requirements of section 812 of the National Defense Authorization Act for Fiscal Year 2024. Section 812 requires offerors to certify that neither the offeror nor its subsidiaries or affiliates hold one or more contracts that involve consulting services with one or more covered foreign entities. Public harm is reasonably likely to result if normal clearance procedures are followed. If DoD remains unaware of the entities, contracts, and subcontracts that are exposed to the risks associated with unmitigated conflicts of interest involving certain consulting services, sensitive information may be compromised, which would affect DoD's mission readiness.
