The COPPA Rule, 16 CFR Part 312, implements the Children's Online Privacy Protection Act (COPPA Act), which prohibits unfair and deceptive acts and practices in collecting and using personally identifiable information from and about children via the Internet. The COPPA Rule implements this mandate by requiring commercial websites to provide notice and obtain parental consent before collecting, using, or disclosing personal information from children under age thirteen, with limited exceptions.
The Commission seeks to extend for an additional three years the current OMB clearance for these information collection requirements of the Rule.
There are no program changes. The estimated annual labor costs are adjusted upward by $8,597,793 (from $5,783,700 in 2022 to $14,381,493 in 2025). The increase is attributable to increases in the estimated number of covered entities and hourly wage rates, and the fact that, in assessing fees charged for complex civil litigation in the District of Columbia, the DOJ and courts have shifted from the Laffey Matrix to the Fitzpatrick Matrix. As such, FTC staff used the Fitzpatrick Matrix, rather than the Laffey Matrix, as a proxy for the market rates for litigation counsel in the Washington, DC, area.
