With the publication of the Economic Growth Regulatory Relief and Consumer Protection Act: Implementation of National Standards for the Physical Inspection of Real Estate (NSPIRE) final rule on May 11, 2023 (88 FR 30442) HUD communicated that it would consolidate existing Uniform Physical Condition Standard (UPCS) information collections into a new information collection for the NSPIRE final rule.
All HUD housing as defined in 24 CFR 5.701(c) are to adhere to NSPIRE inspection regulations, and all applicable requirements, procedures, and timeframes. This NSPIRE information collection includes the following:
⢠Tenant Involvement in inspections as codified inâ24 CFR 5.705(f), under 24 CFR 5.705 Inspection Requirements
⢠Housing Choice Voucher and Project Based Voucher as codified under 24 CFR 5.705(c)(5) and 24 CFR 5.705(c)(6) as it relates to the NSPIRE Inspection Form HUD-52580 and Inspection Booklet, HUD-52580A. These forms will be discontinued and replaced with other optional checklists available in standard office software and as an application for mobile devices.
⢠Uniform self-inspection requirement and report codified at 24 CFR 5.707
⢠The electronic documentation of correction for life-threatening and severe deficiencies codified at 24 CFR 5.711(c)(1), Scoring, Ranking Criteria, and Appeals, Inspection Report Requirements, Life-threatening and severe deficiencies.
⢠Full project surveys by the POA/PHA for properties that scored below 60 as outlined in 24 CFR 5.711(c)(2), Post Report Inspection, and
⢠Technical Reviews (appeals) as defined in 24 CFR 5.711(d), under Scoring Ranking Criteria: Technical review of inspection results
HUD REAC is requesting an expedited review of this new information collection. As background, this new information collection completed departmental clearance in July 2024. Due to staff changes and unanticipated delays, the submission to ROCIS was overlooked until October 2024. Now, the OMB submission needs to be expedited review because the NSPIRE final rule (went into effect July 1, 2023) requires a new OMB collection. Generally, the information collection requirements contained in the NSPIRE rule have already been approved by OMB under the Paperwork Reduction Act and 60-day public comment period and has assigned OMB control numbers that have since expired.
These final regulations include additional requirements not previously considered. Given that, HUD will consolidate existing (expired) information collections into a new collection for the NSPIRE final rule prior to the effective date of the new requirements. The information collection requirements when approved will be assigned an OMB approval number and the public will be notified of this number.
