The Health Eligibility Center (HEC) Income Verification (IV) Forms received one comment on June 17, 2025 in response to the 60-Day Federal Register Notice at 90 FR 16596 (VA-2025-VACO-0001-0008).


VA-2025-VACO-0001-0030 We appreciate the commentor’s concerns-suggestions, and VA responds as follows:


  • That this agency collection is in violation of regulatory requirements and should be terminated.

It is not clear what possible violation the commentor is referring to, but VHA Directive 1909 provides policy for the Department of Veterans Affairs (VA) Health Eligibility Center (HEC) Income Verification (IV) Program under authority of 38 United States Code (U.S.C.) 1722; 38 U.S.C. 5317. VA is in compliance with these requirements.


  • That the agency contract was implemented by agency that is part of rule-making.

It is not clear what the commentor is referring to in this statement. As noted above, VA is in compliance with the stated authority.


  • That the sharing of sensitive data and other data could pose risks to unauthorized persons that may cause additional legal damage or harm if the information is compromised.

Title 38, United States Code, Sections 501(a), 1705, 1710, 1722, 5317 and Public Law 101–508 grant VA the authority to verify Veterans’ self-reported household income to determine eligibility for medical benefits. VA also has the authority to verify Veterans’ self-reported income with the Internal Revenue Service (IRS) and Social Security Administration (SSA). With the exception of Federal Tax Information (FTI), VA may make routine use disclosure under the authority of 45 CFR Parts 160 and 164 which permits such disclosures. VA protects all personal information to the extent required by law.


IVD appreciates the opportunity to review and respond to the comments. As noted above, we do not intend to make changes to the information collection at this time.
