On April 5, 2006, the FCC adopted the Report and Order and Third Order on Reconsideration. The final rules modify the Commission's rules on unsolicited facsimile advertisements to implement the Junk Fax Prevention Act of 2005. The reporting and recordkeeping requirements are the best means of implementing the Junk Fax Prevention Act and preventing unsolicited fax advertisements. Also, the Commission is moving the Form 1088 into a different collection, 3060-0874, for purposes of consolidating the collections regarding FCC complaint forms. This collection will no longer include the Form 1088.
Because the number of complaints filed with the Commission claiming junk fax violations decreased, this information collection is revised slightly from the previous collection:
The Commission notes the following changes:
(a) The total number of respondents has increased by 1,080 from 5,340,000 to 5,341,080, the total number of responses annually has decreased by 170, from 6,050,905 responses to 6,050,735 responses as a result of a revised estimate of the number of complaints filed annually
with the Commission;
(b) The total annual burden hours have decreased by 85 hours, from 3,670,625 hours to 3,670,540 hours for the existing approved information collection requirements;
(c) The total annual cost burden has not changed.
There are no program changes to this collection.
