Under 42 USC 2210, the Department of Justice would require personal information from individuals applying to receive funds under the Radiation Exposure Compensation Act in order to determine their eligibility.
Emergency approval of this ICR will enable the public to submit immediate applications for compensation under the amended Downwinder, Onsite Participant, Uranium Worker, and Manhattan Project Waste provisions of RECA in a manner that does not delay or inhibit adjudication within the 1-year period required under the statute. In addition, emergency approval of this ICR will allow the DOJ to implement an electronic filing platform consistent with the questionnaires set forth on the forms. These steps are essential to ensuring that claims under RECA are adjudicated within the newly amended law's strict statutory limits in a manner that protects the taxpayer and the claimant.
RECA has revised existing eligibility criteria for individuals presumed to have been harmed by exposure to radiation from U.S. Atmospheric nuclear testing, defense-related and civilian uranium extraction efforts, and Manhattan Project waste disposal.
