This information collection is necessary to determine the statutory eligibility for cancellation of removal of individual aliens determined to be removable from the U.S. and to provide information relevant to a favorable exercise of discretion.

Burden changes are due in part to a new statute and in part to adjustments in agency estimates. The One Big Beautiful Bill Act required increases in filing fees associated with the Form EOIR-42A and EOIR-42B. The time burden changed due to an observed decrease in the average number of responses received annually.
