What Is the Purpose of Form I-527?
This form is used by an investor to amend a Form I-526, Immigrant Petition by Alien Investor, filed before March 15,
2022, in order to retain eligibility under the Immigration and Nationality Act (INA) 203(b)(5)(M) where the investor’s
regional center is terminated, or their new commercial enterprise (NCE) or job-creating entity (JCE) is debarred.

Who May File Form I-527?
You may file this form for yourself if you filed a Form I-526, Immigrant Petition by Alien Investor, before March 15,
2022, and you are seeking to retain eligibility under INA 203(b)(5)(M) because your regional center has been terminated
or your new commercial enterprise or job-creating entity has been debarred and you do not otherwise continue to be
eligible notwithstanding such termination or debarment (for example, because the requisite amount of capital has been
or will continue to be invested in your original new commercial enterprise and the requisite number of jobs have been or
will be created in accordance with your originally filed business plan). To maintain your eligibility if your regional center
is terminated, your new commercial enterprise may associate with another designated regional center, or you may make
a qualifying investment in another new commercial enterprise. If your new commercial enterprise or job-creating entity
is debarred, you may associate with another new commercial enterprise in good standing and invest additional capital
necessary to satisfy any remaining job creation requirements.
Complete all parts of this form with information related to the new regional center, new commercial enterprise, jobcreating entity and/or investment, as applicable. In addition, describe the circumstances related to any new associations
and/or investments in Part 12. Additional Information.
For investors who filed a Form I-526, Immigrant Petition by Alien Investor, before March 15, 2022, the amount of
investment required is set by statute based on the amount required when you filed the petition you are seeking to amend.
In general, the required amount of investment is $1,000,000. For investment in a targeted employment area (meaning a
rural area or a qualifying high unemployment area), the required amount of investment is reduced to $500,000. You may
obtain additional information from our website at www.uscis.gov, or a U.S. Embassy or U.S. Consulate abroad.
General Instructions
We provide free forms through the USCIS website. To view, print, or complete our forms, you should use the latest
version of Adobe Reader, which you can download for free at http://get.adobe.com/reader/.
Signature. You (or your signing authority) must properly complete your petition. USCIS will not accept a stamped or
typewritten name in place of any signature on this petition. If you are under 14 years of age, your parent or legal guardian
may sign the petition on your behalf. A legal guardian may also sign for a mentally incompetent person. If your petition
is not signed, or if the signature is not valid, we will reject your petition. See 8 CFR 103.2(a)(7)(ii)(A). If USCIS accepts
a request for adjudication and determines that it has a deficient signature, USCIS may deny the request.
Validity of Signatures. USCIS will consider a photocopied, faxed, or scanned copy of an original handwritten signature
as valid for filing purposes. The photocopy, fax, or scan must be of the original document containing the handwritten ink
signature.

Evidence. When you file your petition, you must submit all evidence and supporting documents listed in the Specific
Instructions section of these Instructions.
Biometric Services Appointment. USCIS may require you to appear for an interview or provide biometrics (fingerprints,
photograph, and/or signature) at any time to verify your identity, obtain additional information, and conduct background
and security checks, including a check of criminal history records maintained by the Federal Bureau of Investigation
(FBI), before making a decision on your application or petition. If we determine that a biometric services appointment
is necessary, we will send you an appointment notice with the date, time, and location of your appointment. If you are
currently overseas, your notice will instruct you to contact a U.S. Embassy, U.S. Consulate, or USCIS office outside the
United States to schedule an appointment.

At your biometrics appointment, you must sign an oath reaffirming that:
1. You provided or authorized all information in the petition;
2. You reviewed and understood all of the information contained in, and submitted with, your petition; and
3. All of this information was complete, true, and correct at the time of filing.
If you do not attend your biometric services appointment, we may deny your petition.
Copies. You should submit legible photocopies of requested documents unless the Instructions specifically instruct you to
submit an original document. USCIS may request an original document at any time during our process. If we request an
original document from you, we will return it to you after USCIS determines it no longer needs the original.
NOTE: If you submit original documents when they are not required or requested, USCIS may destroy them after we
receive them.
Translations. If you submit a document with information in a foreign language, you must also submit a full English
translation. The translator must sign a certification that the English language translation is complete and accurate, and that
they are competent to translate from the foreign language into English. The certification must also include their signature,
printed name, the signature date, and their contact information.

1. Type or print legibly in black ink.
2. If you need extra space to complete any item within this petition, use the space provided in Part 12. Additional
Information or attach a separate sheet of paper; type or print your name and Alien Registration Number (A-Number)
(if any) at the top of each sheet; indicate the Page Number, Part Number, and Item Number to which your answer
refers; and sign and date each sheet.
3. Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been
married and the question asks, “Provide the name of your current spouse”), type or print “N/A” unless otherwise
directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many
children do you have” or “How many times have you departed the United States”), type or print “None” unless
otherwise directed.

Part 1. Petition Amendment
Item Number 1. Provide the receipt number of the petition you are seeking to amend. This number is available on the
receipt notice USCIS sent you after you submitted your petition.
Item Numbers 2. - 3. Select the reason you are submitting this amendment, either (2) Termination of the Regional Center
or (3) NCE/JCE Debarment. The “Notice Date” is the date on the notice you received from USCIS informing you that
your regional center was terminated or that your new commercial enterprise or job-creating entity was debarred.

If Termination of Regional Center is checked, indicate if your NCE has associated with a new approved regional center or
if you have made a qualifying investment in another NCE.
If NCE or JCE Debarment is checked, indicate if you associated with a new NCE in good standing and if you have
invested additional investment capital to satisfy any outstanding job creation requirements.
Part 2. Information About You
Item Number 1. Alien Registration Number (A-Number) (if any). Provide your A-Number. We use your A-Number
to identify your immigration records. It begins with an “A” and can be found on correspondence you have received from
the Department of Homeland Security (DHS) or USCIS. If you do not have an A-Number, type or print “N/A.”
Item Number 2. USCIS Online Account Number. You will only have a USCIS Online Account Number (OAN) if you
previously filed a form that has a receipt number that begins with IOE. If you filed the form online, you can find your
OAN in your account profile. If you mailed us the form, you can find your OAN at the top of the Account Access Notice
we sent you. If you do not have a receipt number that begins with IOE, you do not have an OAN. The OAN is not the
same as an A-Number.
Item Number 3. Your Full Name. Provide your full legal name in the spaces provided.
Item Number 4. Other Names Used (if any). Provide all the names you have used, including maiden name, married
names, and nicknames, in the space provided.

Item Number 5. Date of Birth. Provide your date of birth in a mm/dd/yyyy format.
Item Number 6. Country of Citizenship or Nationality. Provide the name of the country where you are a citizen and/
or national. This is not necessarily the country where you were born. If you do not have citizenship in any country, type

business means a business that has been in existence for at least two years, has incurred a net loss for accounting purposes
(determined on the basis of generally accepted accounting principles) during the twelve- or twenty-four month period
prior to the priority date on the alien investor’s Form I-526, and the loss for such period is at least equal to twenty percent
of the troubled business’s net worth prior to such loss. For purposes of determining whether the troubled business has
been in existence for two years, successors in interest to the troubled business will be deemed to have been in existence
for the same period of time as the business they succeeded.

Item Number 4. Select this box if your investment is in a rural area. A rural area is an area outside a metropolitan
statistical area (MSA) (as designate by the Director of the Office of Management and Budget) and outside the outer
boundary of a city or town with a population of 20,000 or more based on the most recent decennial census of the United
States..
Item Number 5. High Unemployment Area. Indicate whether your petition is based on an investment in a high
unemployment area. A high unemployment area is a metropolitan statistical area (MSA), a specific county within an
MSA, or the county in which a city or town with a population of 20,000 or more is located, in which the new commercial
enterprise is principally doing business has experienced an average unemployment rate of 150 percent of the national
average rate. The state government of any state of the United States may designate a particular geographic area or
political subdivision located within an MSA or within a city or town having a population of 20,000 or more within such
state as an area of high unemployment. If your petition previously relied on a state designation of your NCE’s project
area, you may continue to rely on that designation if the NCE is continuing to principally do business in that area. You

Number 1., did not create any employment prior to filing this amendment, and the reassociated NCE is affiliated with a
regional center, indicate whether the petition relies on indirect job creation demonstrated by an economic model and, if
yes, indicate the economic model used in Part 12. Additional Information.
Item Number 5. Estimated Full-Time Positions That Will Be Created. Indicate how many estimated direct full-time
positions for qualifying employees will be created by the new reassociated NCE (Part 4., Item Number 3.) and, if your
petition is based on an investment in a regional center, how many estimated direct and indirect jobs will be created by the

proceedings before the Department of Homeland Security (DHS) or the Department of Justice’s Executive Office for

indicate whether you are currently subject to a final order of exclusion, deportation, or removal, or subject to reinstatement

What Evidence Must You Submit?
You must submit all evidence requested in these instructions with your petition. If you fail to submit required evidence,
USCIS may reject or deny your petition for failure to submit requested evidence or supporting documents in accordance
with 8 CFR 103.2(b)(1) and these Instructions.
Evidence to Accompany Petition
The following evidence must, when applicable, be filed with your petition:

1. Lawful Business Entity. Evidence that you have invested in, or are actively in the process of investing in, a lawful
business entity validly formed after November 29, 1990, and validly operating under the laws of the jurisdiction in the
United States in which it is located. If you made an investment in a business formed on or before November 29, 1990,
you must submit evidence that your investment resulted in a restructuring or reorganization of the business or has
caused a substantial (at least 40 percent) increase in the net worth of the business, the number of employees, or both.
Such evidence shall, as applicable, consist of:
A. Copies of articles of incorporation, certificate of merger or consolidation, partnership agreement, certificate of
limited partnership, joint venture agreement, business trust agreement, or other similar organizational document;

B. A certificate evidencing authority to do business in a state or municipality, or if such is not required or issued, a
statement to that effect; or
C. Evidence that, as of a date after November 29, 1990, the required amount of capital was transferred to an existing
business resulting in a substantial increase in the net worth or number of employees. This evidence must be in the
form of stock purchase agreements, investment agreements, certified financial reports, payroll records, or other
similar instruments, agreements, or documents evidencing the investment and the resulting substantial change.
2. Targeted Employment Area. Evidence, if applicable, that your enterprise has created or will create employment
in a targeted employment area. A targeted employment area is defined as an area that, at the time of investment, is
a rural area or is designated as an area that has experienced an average unemployment rate of at least 150 percent of
the national average rate. A rural area is an area not within a metropolitan statistical area and not within the outer
boundary of any city or town having a population of 20,000 or more.
If the targeted employment area is rural, you must provide evidence that the new commercial enterprise is principally
doing business within a civil jurisdiction not located within any metropolitan statistical area as designated by the
Office of Management and Budget, nor within any city or town having a population of 20,000 or more as based on the
most recent decennial census of the United States.
If the targeted employment area is an area of high unemployment, you must provide either:
A. Evidence the metropolitan statistical area, the specific county within a metropolitan statistical area, the county
in which a city or town with a population of 20,000 or more is located, or the city or town with a population of
20,000 or more outside of a metropolitan statistical area, in which the new commercial enterprise is principally
doing business has experienced an average unemployment rate of 150 percent of the national average rate; or
B. A description of the boundaries and the unemployment statistics for the area for which designation is sought as set
forth in 8 CFR 204.6(i), and the reliable method or methods by which the unemployment statistics were obtained.
3. Investment. Evidence that you have invested or are actively in the process of investing the required amount of
capital.
Such evidence may include, but need not be limited to, copies of bank statements showing amounts deposited into
the U.S. business accounts for the enterprise, evidence of assets that have been purchased for use in the enterprise,
evidence of property transferred from abroad for use in the enterprise (including U.S. Customs and Border Protection
commercial entry documents, bills of lading, and transit insurance policies containing ownership information and
sufficient information to identify the property and to indicate the fair market value of such property), evidence of
monies transferred or committed to be transferred to the NCE in exchange for shares of stock that cannot be redeemed
at the holder’s request, or any loan or mortgage agreement, promissory note, security agreement, or other evidence of
borrowing that is secured by assets owned by the petitioner (other than those of the NCE) and for which the petitioner
is personally and primarily liable.

4. Lawful Capital. Evidence that the capital you invested or are actively in the process of investing was obtained
through lawful means. You must include the following documents, as applicable, with your petition: foreign
business registration records, tax returns of any kind filed by you or on your behalf within the last five years in or
outside the United States, evidence of other sources of capital, or certified copies of any judgments, or evidence of all
pending governmental administrative, civil or criminal actions, and any private civil actions (pending or otherwise)
involving monetary judgments against the petitioner from any court in or outside the United States within the past 15
years.

5. Job Creation. Evidence that the enterprise has created or will create at least ten full-time positions for qualifying
employees. Qualifying employee means a U.S. citizen, lawful permanent resident, or other immigrant lawfully
authorized to be employed in the United States. This definition does not include you, your spouse, your sons or
daughters, or any nonimmigrant alien. Such evidence must consist of copies of relevant tax records, Form I-9s, or
other similar documents, if the employees have already been hired, or a comprehensive business plan showing when
such employees will be hired.
For cases involving troubled businesses, the petition must be accompanied by evidence that the number of
