Privacy Act Statement
Pursuant to 5 U.S.C. § 552a(e)(3), this Privacy Act Statement serves to inform you of why DHS is requesting the information on this form.
AUTHORITY:
CBP is authorized to collect the information requested on this form pursuant to 19 CFR 4.62, 4.63, 4.75, 4.76, 4.82, and 4.87-4.89.
19CFR4.63 requires the vessel master or the vessel agent on behalf of the master to file a vessel cargo manifest on a paper CBP form 1302A, cargo declaration
outward with commercial forms, with copies of the bills of lading or equivalent commercial documents relating to all cargo encompassed by the manifest to CBP
at each port from which clearance is being sought.
19CFR4.76 sets forth the procedures and responsibilities of carriers filing the outbound vessel manifest information via the Automated Commercial Environment
system in lieu of the paper for CBP form 1302-A.
PURPOSE:
The master or commander of a vessel departing from the United States must file CBP Form 1302A, or CBP-approved electronic equivalent, with copies of bills of
lading or equivalent commercial documents relating to all cargo encompassed by the manifest. CBP is requesting this information to facilitate the movement of
compliant shipments and to identify potential issues early in the supply chain. CBP uses the information on the CBP Form 1302A for pre-arrival targeting
shipments for enforcement examination purposes.
ROUTINE USES:
The information requested on this form may be shared externally as a “routine use” to other federal, state, local, tribal or foreign government agencies or
multilateral government organizations responsible for investigating or prosecuting the violations of, or for enforcing or implementing, a statute, rule, regulations,
order, license or treaty when DHS determines that the information would assist in the enforcement of civil or criminal laws. A complete list of the routine uses can
be found in the system of records notices associated with this form, “Department of Homeland Security/U.S. Customs and Border Protection - 001 Import
Information System and 020 Export Information System.” The Department's full list of system of records notices can be found on the Department's website at

CONSEQUENCES OF FAILURE TO PROVIDE INFORMATION:
CBP Form 1302A is required to be completed by any person or entity responsible for the cargo being imported or exported, including carriers, shippers or their
authorized agents. Failure to complete CBP Form 1302A accurately and timely can result in penalties or delays in the clearance of the cargo by CBP.
