Terms of Clearance
As an OMB-recognized statistical agency, NCHS has responsibilities under CIPSEA, including participation in the Standard Application Process (SAP). NCHSâs rationale for not participating in the SAP is that the dataset does not fall under CIPSEA. However, SAP participation extends beyond CIPSEA-covered data and is expected for restricted, non-public datasets held by OMB-recognized statistical agencies and units pursuant to the Evidence Act, unless otherwise prohibited by law.
OMB clears this package for one year, subject to the following conditions:
1. NCHS will engage with OMB, the SAP PMO, NCHS OGC, OMB OGC, and any other relevant parties to determine the appropriate pathway for SAP participation or to identify any legal constraints that would preclude participation.
2. NCHS will submit to OMB a timeline and action plan outlining steps toward SAP participation in consultation with the SAP PMO or, if applicable, a documented legal justification for non-participation within 6 months of clearance.
3. NCHS will resubmit the package for OMB review within one year, including an update on progress toward SAP participation or a finalized determination regarding participation.

NCHS is the Nationâs principal health statistics agency and compiles statistical information to guide actions and policies to improve the health of the U.S. population. The data systems administered by NCHS are a unique public resource for health information, a critical element of public health and health policy. Making these data available to the public upon request is an essential mission of NCHS.
Since 1991, the NCHS DVS has sought to make restricted-use NCHS vital statistics data available to authorized researchers in a secure manner that protects the data from unauthorized disclosure.
The DVS proposal collects information that is used by NCHS to assess and adjudicate researcher projects to determine whether access to restricted-use vital statistics data should be granted under the conditions established by the jurisdictions.
