Improving Wage Protections for the Temporary and Permanent Employment of Certain Foreign
Nationals in the United States
Dear Mr. Pasternak:
I am writing in opposition to this proposed rule. I have been an immigration attorney for nearly
a decade, and I work with many small businesses across the U.S. My clients are good employers
and a strong part of our vibrant and successful business community. They hire U.S. workers,
pay business taxes, and provide goods and services. Sometimes, these small business owners
hire noncitizen workers to fill a vital need within their company. In each case, they have
identified that this new hire is the best person for the job, and they are often hiring a noncitizen
worker because of a lack of qualified U.S. workers in the applicant pool. For my clients, the
proposed rule sharply increasing wage requirements would be catastrophic. Unlike tech giants
like Amazon, Google, Meta, and Microsoft, small businesses cannot afford to pay well above
market rates for their workers. I urge you to reconsider this rule that will unfairly impact the
smallest businesses who are working hard to succeed in a tough business environment.
