OMB. Control Number 1545-2000
1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION
Notice 2023-24 provides guidance under section 45J of the Internal Revenue Code regarding the credit for production of electricity from advanced nuclear power facilities. The notice establishes procedures for allocating the remaining national megawatt capacity limitation (NMCL) to eligible advanced nuclear power facilities and provides procedures under section 45J(e) for qualified public entities to elect to transfer all or a portion of the section 45J credit to an eligible project partner. The collection of information covered by this supporting statement consists of the Section 45J(e) Election Statement described in Section 7 of Notice 2023-24. The election statement identifies the qualified public entity, the eligible project partner, the facility, the amount of credit transferred, and other information necessary for the eligible project partner to claim the credit and for the IRS to administer the transfer provisions of section 45J.
2. USE OF DATA
The information will be used to determine the portion of the section 45J credits to which an eligible project partner is entitled and will be used by the eligible project partner to claim the credit.
3. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN
The IRS does not currently provide an electronic method for submitting these narrative statements and third-party disclosures.
4. EFFORTS TO IDENTIFY DUPLICATION
The information obtained through this collection is unique and is not already available for use or adaptation from another source.
5. METHODS TO MINIMIZE BURDEN ON SMALL BUSINESSES OR OTHER SMALL ENTITIES
The collection does not impose a significant economic impact on a substantial number of small entities.
6. CONSEQUENCES OF LESS FREQUENT COLLECTION ON FEDERAL PROGRAMS OR POLICY ACTIVITIES
Without this information, the IRS could not verify transfers of section 45J credits or determine the amount of credit that an eligible project partner is entitled to claim.
7. SPECIAL CIRCUMSTANCES REQUIRING DATA COLLECTION TO BE INCONSISTENT WITH GUIDELINES IN 5 CFR 1320.5(d)(2)
There are no special circumstances requiring data collection to be inconsistent with Guidelines in 5 CFR 1320.5(d)(2).
8. CONSULTATION WITH INDIVIDUALS OUTSIDE OF THE AGENCY ON AVAILABILITY OF DATA, FREQUENCY OF COLLECTION, CLARITY OF INSTRUCTIONS AND FORMS, AND DATA ELEMENTS
In response to the Federal Register notice (91 FR 8058), dated February 19, 2026, we received no comments during the comment period regarding Notice 2023-24.
9. EXPLANATION OF DECISION TO PROVIDE ANY PAYMENT OR GIFT TO RESPONDENTS
No payment or gift has been provided to any respondents.
10. ASSURANCE OF CONFIDENTIALITY OF RESPONSES

14. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT

15. REASONS FOR CHANGE IN BURDEN
There is no change in the paperwork burden.
16. PLANS FOR TABULATION, STATISTICAL ANALYSIS AND PUBLICATION
There are no plans for tabulation, statistical analysis and publication.
17. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE
The IRS believes that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the collections expire as of the expiration date. Taxpayers are not likely to be aware that the IRS intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
