FINAL RULE: Risk-Informed,
Technology-Inclusive Regulatory Framework for Advanced Reactors The
NRC is amending its regulations by adding a risk-informed,
performance-based, and technology-inclusive regulatory framework
for commercial nuclear plants in response to the Nuclear Energy
Innovation and Modernization Act (NEIMA). The current application
and licensing requirements were primarily developed to address
license requests concerning light water-cooled reactors and
operational requirements for those types of reactors. This final
rule responds to NEIMA by creating an alternative,
technology-inclusive regulatory framework to accommodate licensing
of future commercial nuclear plants, including advanced reactor
designs that may not employ light-water technology. The information
collections associated with the final rule have been submitted
under the following clearance numbers: 3150-0146 Burden for 10 CFR
Part 26 (revision) 3150-0274 Burden for 10 CFR Part 53 (new
clearance number for a new CFR Part) 3150-0272 NRC Forms 893 and
894 (new clearance number for a new form) 3150-0002: 10 CFR Part 73

10 CFR Part 50 (temporary clearance number, 3150-0011 is currently
unavailable for submissions due to the Alternatives to the Use of
Credit Ratings final rule) 3150-XXXX: Burden for NRC Form 361
(temporary clearance number, 3150-0238 will soon be unavailable due
to the upcoming renewal of this form) 3150-XXXX: Burden for NRC
Form 396 (temporary clearance number, 3150-0027 is currently
unavailable for submissions due to renewal) 3150-XXXX: Burden for
NRC Form 398 (temporary clearance number, 3150-0090 is currently
unavailable for submissions due to the renewal)
As a result of the final rule,
the estimated annual burden for information collection requirements
for Part 26 increases by 9,055 hours, from 540,050 to 549,105
hours. The NRC staff anticipates that there will be five Part 53
licensees and one Part 53 applicant in the period covered by this
clearance. 10 CFR 26.3(f) states that Part 53 applicants and
licensees may elect to implement the alternate FFD program
described in Subpart M of Part 26. Therefore, the estimated annual
burden is expected to increase by 9,055 hours as a result of the
reporting, recordkeeping, and third-party disclosure requirements
that the five Part 53 licensees and one Part 53 applicant need to
fulfill to comply with Part 26 during the period covered by this
clearance (2027-2029).
