This is to request approval from the Office of Management and Budget (OMB) for a revision of previously approved information collection titled, âHazardous Materials Shipping Papers and Emergency Response Information,â under OMB Control No. 2137-0034. This information collection is currently due to expire on November 30, 2026. This OMB Control Number covers hazardous materials shipping papers and emergency response information, which in accordance with the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180), are required to accompany each shipment of hazardous materials in commerce. On April 10, 2024, PHMSA published the HM-215Q final rule titled âHazardous Materials: Harmonization With International Standardsâ [89 FR 25434]. This final rule revises §â173.185(c)(4) to require that shippers and carriers of small lithium batteries not contained in equipment have shipping papers and perform Notice of Pilot in Command (NOPIC) checks when transported by air.
This information collection request reflects a increase in responses, burden hours and salary cost. The increase stems from the HM-215R NPRM titled âHazardous Materials: Harmonization With International Standards.â This NPRM proposes to revise § 173.185(a)(3) to change the applicability in §â173.185(a)(3) to apply to sodium ion cells and batteries. This will result in sodium ion battery manufacturers having to produce and to share a test summary document that is currently only required by lithium cells and batteries. The inclusion of sodium ion batteries will also result in a slight increase in the overall shipping paper burden.
