Section 214 of the Housing and Community Development Act of 1980, as amended, (42 U.S.C. 1436a) prohibits HUD from making financial assistance available to persons who are ineligible for assistance with respect to citizenship or non-citizen immigration status and applies to both applicants for assistance and persons already receiving assistance under: (1) Section 235 of the National Housing Act (the Section 235 Program); (2) Section 236 of the National Housing Act (tenants paying below market rent only) (the Section 236 Program); (3) Section 101 of the Housing and Urban Development Act of 1965 (the Rent Supplement Program); and the United States Housing Act of 1937 - (i) HUD's Public Housing Programs; (ii) Section 8 Housing Assistance Programs; and (iii) the Housing Development Grant Programs (with respect to low income units only). This PRA covers Form HUD-9886 and its translations for HUD's Public Housing and Section 8 programs operated by the Office of Public and Indian Housing (PIH).

The total annual burden of this collection has fallen from 538,970 hours in 2023 to 42,727 hours currently. In 2023, the tabulation of annual reporting burden included the burden of one-time execution of the updated Form HUD-9886-A by current Public Housing and Housing Voucher Program participants. This one-time execution was required for approximately 4,203,135 respondents and accounted for 336,251 hours. Once a participant family has executed the Form HUD-9886-A, per 24 CFR 5.230(c)(5), that authorization remains effective until the earliest of: the rendering of a final adverse decision for an assistance applicant, the cessation of a participantâs eligibility for assistance from HUD and the PHA, or the express revocation by the assistance applicant or recipient (or applicable family member) of the authorization, in a written notification to HUD. Because participant families have at this made the one-time execution required by the shift to the Form HUD-9886-A, this burden does not need to be included again. Instead, the only burden that needs to be included relates to new tenant admissions and execution of Form HUD-9886-A by household members that turn 18 years old. Likewise, the total annual burden associated with the Restriction on Assistance to Noncitizens has also fallen. This is attributable to differences in the number of respondents, frequency of responses, and age of the data. The 2023 estimate used an average of FY 2010-2012 data, whereas the current estimate uses an average of FY 2022-2024 data.
