Abstract: Under the Interstate Commerce Act, Pub. L. No. 104-88, 109 Stat. 803 (1995), liens on rail equipment must be filed with the STB in order to perfect a security interest in the equipment. Subsequent assignments of rights or release of obligations under such instruments must also be filed with the agency. This information is maintained by the Board for public inspection. Recordation at the STB obviates the need for recording such a lien in individual States.

Short Statement: This is an existing collection, which requires an adjustment to the hourly burdens based on the actual number of liens recorded since the last approval of this collection by OMB in 2023. Based on the number of liens recorded in CY 2023-2025, the Board estimates that the average number of liens to be recorded at the Board will decrease from 1, 750 to approximately 1,120 responses.
