In response to the emergency request memorandum submitted by the Department of State, OIRA is approving this collection for 6 months. Prior to the expiration of this emergency approval, the Department shall undertake standard notice and comment procedures and describe in its next ICR submission all comments received and the extent to which commenters' recommendations were adopted.

The Visa Fraud Reporting Form allows members of the public to report suspected visa fraud or misuse directly to the Bureau of Consular Affairs for investigation and, where warranted, immediate action, including visa revocation under the Secretary of State's exclusive authority.
No dedicated reporting channel currently exists, and that gap has immediate national security consequences. The Immigration and Nationality Act renders inadmissible any alien who has procured, or sought to procure, a visa by fraud or willful misrepresentation of a material fact [INA § 212(a)(6)(C), 8 U.S.C. § 1182(a)(6)(C)], and vests in the Secretary of State the exclusive, non-reviewable authority to revoke a visa at any time, in his discretion [8 U.S.C. § 1201(i)]. That authority is only as effective as the information available to exercise it, and the public currently has no purpose-built way to deliver that information to the office with authority to act on it. Standing up this form is direct implementation of the President's border security and visa integrity directives, not a discretionary process improvement that can await routine clearance.
